El transporte marítimo en régimen de fletamiento (TRAMP) y su importancia para el derecho marítimo

Abstract

El presente documento refiere a los distintos tipos de contratos existentes en el transporte marítimo, con un enfoque particular en el transporte marítimo en régimen de fletamento (tramp), así como sus tres modalidades: a casco desnudo (bareboat charter); por tiempo (time charter) y por viaje (voyage charter o trip charter). De igual manera, se advierte la importancia de conocer la terminología esencial de los elementos personales del contrato de fletamento (charter party), tanto en español como en inglés. Sin este conocimiento, la explotación comercial de los buques sería prácticamente inexistente. Por ello, la Secretaría de Marina, como Autoridad Marítima Nacional, así como los tribunales de la federación en México, requieren conocer de todas las controversias contractuales que pudieran presentarse en esta materia.

This document refers to the different types of existing contracts in maritime transport, with a particular focus on the chartering regime (tramp), as well as its three modalities: bareboat charter; time charter and voyage charter or trip charter. Similarly, it shows the importance of knowing the essential terminology of the personal elements of the charter party, both in English and in Spanish. Without this knowledge, the commercial exploitation of ships would be practically non-existent. For this reason, the Secretariat of the Navy, as the National Maritime Authority, as well as the Mexican tribunals, require knowing all the contractual controversies that could arise related to this subject.
