La guardia costera en México

Abstract

«El que puede lo más puede lo menos» es un principio general de derecho que refleja el objetivo de este trabajo. Con las modificaciones que se realizaron a la legislación nacional en 2016, 2017 y 2020, que otorgan a la Secretaría de Marina (MARINA) la Autoridad Marítima Nacional (AMN), la administración de las capitanías de puerto, el ejercicio de funciones de Guardia Costera y la Autoridad Portuaria en México, prácticamente todo el espectro que regula la Organización Marítima Internacional (OMI) se encuentra ahora a cargo de esta Institución. Algunas figuras, que en su momento se crearon para suplir algunas lagunas jurídicas en materia de protección marítima (maritime security), fueron muy útiles en su momento. Sin embargo, ante la nueva realidad que encara la institución, se vuelve necesaria la integración, optimización y potencialización de recursos de la Guardia Costera, cuyas funciones, que habría que puntualizar, cumplen e incluso exceden las de aquellas figuras que permanecen hasta la fecha. Por lo anterior, en este artículo se observa la «Guía modelo de operaciones marítimas de la Guardia Costera de los Estados Unidos de América» con el objetivo de retomar las mejores prácticas para el desarrollo y operación del servicio marítimo que se espera por parte de una Guardia Costera en materias de: defensa nacional, seguridad marítima, protección marítima y prevención de la contaminación marina. Ello permitirá también a la MARINA enfocarse en los nuevos retos que encara en materia aduanera y portuaria.

As a result of the amendments of national legislation, in 2016, 2017 and 2020, the Secretariat of the Navy (MARINA) was granted the exercise of the National Maritime Authority (AMN), the administration of captains of the port, the Coast Guard and the Port Authority in Mexico. With these legislation updates, practically all the spectrum that regulates the International Maritime Organization (IMO) is now in charge of MARINA. Some existing entities were very useful to fill some legal loopholes in the field of maritime security. However, given the new reality this Institution faces, the optimization of resources to fulfill the responsibilities of the Coast Guard becomes imperative. The current functions of the Coast Guard in Mexico fulfill and even exceeds all those entities that were previously created and remain to date. For this purpose, the “Model Maritime Operations Guide of the United States Coast Guard” is observed, with the aim of retaking the best practices for the development and operation of the maritime service expected by a Coast Guard in Mexico. These subjects include: National defense, maritime safety, maritime security and the prevention of marine pollution. The proposed organization will also allow MARINA to focus on the new challenges it faces regarding customs and port matters.
