Facultades del H. Congreso de la Unión en materia de derecho internacional y poder marítimo

Abstract

El derecho internacional y el poder marítimo son temas de Estado que requieren de la toma de decisiones al más alto nivel. Por lo tanto, el apoyo del H. Congreso de la Unión, en los términos que dispone la Constitución Política de los Estados Unidos Mexicanos(CPEUM), es esencial para el cumplimiento de las responsabilidades actuales de la Secretarìa de Marina (MARINA). El propósito de este trabajo es mostrar las acciones que se han realizado en estas materias, incluyendo la creación del nuevo «Servicio de Apoyo a la Autoridad Marítima (SAAM)». Así mismo, se muestran las ventanas de oportunidad que permitirían al Estado mexicano contar con una «Política Nacional de Transporte Marítimo (NMTP)» en los términos que demanda tanto el derecho interno como la Organización Marítima Internacional (OMI).

International law and maritime power are State issues that require decision-making at the highest level. Therefore, the support of the Mexican Congress, in constitutional terms, for the fulfillment of the current responsibilities of MARINA, is essential. The purpose of this work is to show the actions that had been carried out in these matters. It includes the creation of the new «Maritime Authority Support Service (MASS)». Likewise, it shows the windows of opportunity that would allow the Mexican State to have a «National Maritime Transport Policy (NMTP)» in accordance with domestic law and the International Maritime Organization (IMO).
